He committed Fraud. He did not commit Mail fraud.
I'd bet money the tracking number is NOT from Robhe's address. These are current tracking numbers. If they came from Robhe, they would have had to actually ship something. And it does seem everyone has received a different tracking number. He only gets $17.99 from each buyer. Why spend money shipping something and to a different address? They would have been much better shipping an empty package to each Buyer's actual address, so they could show eBay they did ship.

I ordered from the Daco seller who gave me a Tracking number. That tracking number showed Amazon as the original shipper & it went to another state than mine. So Daco did not actually ship anything. Only used someone else's tracking number. So that is not Mail Fraud. He Did not use USPS.

I agree with your logic, however, using a tracking number illegitimately may still indeed be mail fraud.

But yes, I agree that the probably didn’t ship anything and used tracking numbers that may be legitimate for someone else, and uploaded those numbers into eBay. So it’s really defrauding eBay.

I got a call again from my post office and couldn’t pick up. The message said they’re trying to get a photo of the actual package that was delivered to Trenton. Intriguing...

I thought DJ Bebop said it went to Baltimore (memory is the 1st to go!), not to him & his address. So Nothing was sent to him. Its just someone else's tracking number, unrelated. As I said just before, I don't think they are shipping an item to someone else just to get a tracking number. That means the US Mail was not used by them No Mail Fraud.

If they did not actually use the Mail, it is not Mail Fraud. It may be fraud but not mail fraud.
If someone on TB agrees to sell you something, you send them money (Paypal, check, cash, Amazon gift cards, doesn't matter) and they never ship you anything but they give you a bogus racking number saying its shipped. The USPS will not get involved. You can file thru a police department, even possibly the FBI but most likely you just get to wave goodbye to the money you lost. This used to be a common scam on the Internet, where people would send money after they "know" the item shipped. USPS never got involved.

Yes, something went to Baltimore with my name on it. Yes, it didn't come to my real house in Portland.

Ya know... as much as I hate to say this, I feel I gotta give this person a little bit of credit for such an elaborate scheme. I mean scam. Nobody gets too hurt... he/she makes themselves a couple of thousand dollars - if they don't get caught. It took almost as much effort as a real job.

Can we give this person a 'kudos'!!????

Its keeping a bunch of us out of trouble here for a couple of weeks, too :).

Or am I gonna get in trouble now...

Absolutely Not! For some people it might be a bit of money. At the least I won't give anyone any kudos that takes advantage of other people.

Just trying to be a little light hearted about the whole thing.

I'll add that $14 is a very small price to pay for a lesson like this, too.

When I was 17 years old I had just cashed my $40 pay check in NYC for a part time messenger service job I had. I ran into a 3 card monte dealer. It was a day before xmas eve and I was certain I could double my $40, and get GREAT gifts for my family. I was certain I knew where the card was.

I was an idiot.

I got mad at the guy who took my money for about 5 minutes. Then I placed the blame where it belonged. On me. That was over 40 years ago. I never got scammed again.

I'm supposed to have a bass coming from Robhe, allegedly shipped on 3 March. I never got a tracking number, but I'm not in the US. Latest delivery date is 1 April...that date should have warned me :-)

I'm not expecting anything other than a refund next month from eBay now. It guess will at least save me from having to explain to the wife why a new bass has arrived at the door!

I wonder if someone(s) at USPS is in on this, or if it's just that the seller is making up tracking numbers and the address is something he'd normally enter. Even weirder is ebay saying they never received any tracking info on these basses. So where're the updates coming from?
