Marine Vs. HOA over a flagpole

Correct me if I'm wrong, people, but I think that doing a tour in the recruitment office in the Marines is something you generally have to earn and is actually considered a sign of prestige in that particular branch.

But with that said, I have to agree with the people saying that just because he served doesn't give him the right to break the rules. I'm not a fan of HOAs either. There may be a legitimate reason for the rule or it may be another one of those asinine HOA "Oh noessss, you can't paint your door red, because it will devalue all of our homes by $2.59" type of rule.

This is true. And if the court goes against him and supports the HOA, what if he decides he doesn't like their decision? Does he get to do what he wants anyway? No, he doesn't, not with the court, and not with the HOA. He needs to follow the rules HE AGREED TO WHEN HE MOVED IN THERE.

He served his country, so now he is allowed to be above the rules of others? Granted this is pretty minor in the grand scheme.

Yeah, that was probably a bad example. But, as you say, his service is irrelevant in this situation, he has to follow the rules like anybody else. In order for him to move there, he would have had to sign some sort of contract/lease and that rule would have been part of said contract/lease, and signing it would mean he agreed to follow that rule. He can't just now decide he doesn't like the rule and go ahead and break it just because he feels a sense of entitlement. Yes, he should be praised for his service to this country, But that doesn't give him a free pass to do whatever the hell he wants and go against rules he initially agreed and signed on to.

humm if the rules are the RULES why is there an appeals process?And my patriotic views on his service dont put him above the law but i do think he desirves a real reason if for no other reason than his service.What does it hurt for him to have that flag pole?These are the same kind of people who took the flag out of are schools!Yes he choose to live there but this is still the land of the free.No law or rule is above review!That is what he asked for and they played the paper game with him.But i guess since all of you never break any rules or laws this is hard for you to understand!I mean the speed sign says 50 not 53 right if you got a ticket for 53 in a 50 you wouldnt fight it right!I mean its the law the law is above all else!Come on please think of how many rules and laws you broke just today.Tad bit of info you know you have to come to a complete stop for no less than 3 seconds at a stop sign in the U.S.A if you dont wait 3 second you broke a law!

I belive this case is now going to those with authority(courts).And i feel that he has to do as the court rules!But the hoa is asking for 10 bucks a day for every day it stands i for one would donate money to keep this flag standing!Sounds to me if he pays them they dont mind the pole so much?

You're just getting tangential. It is wrong to disobey rules, that is all. Everyone does it but not everyone claims they are doing the right thing while breaking a rule.

In the end it is nice to see someone ? the rules.they are not perfect and that is why there is an appeals process and even the ability to have a court rule on it.I just dont like the fact that some people think we should all fall in line and do as we are told!I just would like to thank all vets for the ability to be able to do things like debate online with others!Right or wrong we all need to ? the system some times other wise we will start to put the system above are selfs!Rules and laws are meant to work for you not control you and so they be can change or removed to better serve you.

Marines are taught to respect Marine Corps authority and hold everyone else in contempt. The HOA is run by civilians, therefore they are not worthy of respect - or obedience

If this guy was still in the Corps, and showed this kind of open defiance to his superiors, he'd be facing Brig time

He moved into the home. He knew the HOA rules. CASE CLOSED.

Meet the rules or move out. I'm not sympathetic.

I've been an HOA officer and I know how this goes. We'd have worked with him, given him multiple chances to comply, then started enacting fines against him. They'd either have been paid or they would have constituted a lien on the home.

You can't move into an area with specific HOA bylaws, agree to those bylaws, then start erecting flagpoles, digging swimming pools, tearing out the front yard and installing prairie grass, or do other things which don't conform to the HOA bylaws. If you want to do those things, don't buy there.

Being in the military doesn't make him special. I don't care how much he loves his flag.

I know I'll probably be flamed here but I feel this needs to be said. I'm by no means some super conservative or some mega liberal. I'm a 17 year old guy. And I think he should fly the flag however he sees fit. Look at all the crosses at cemeteries reserved for those that served, they died to defend that flag. If displaying the symbol of our country, our history, and the things members of most of our families fought for will "devalue" the other homes then I think we as a society seriously need to reevaluate some things.
