I'm not justifying anything. Just stating my understanding of facts. It's every bit as factual to state that many people prefer Nash basses to Fenders. It probably makes you feel like a vampire in sunlight but it's a fact![]()
Agreed. I guess I could have bought an ash Pbass and a maple neck and board myself and gone through an assembly, fit and finish - but I would have still called the bass my own custom effort. Bear in mind that I don't have a pre-exising Pbass to mod. The custom component for me is trusting Dan to put together what I want and knowing he has way more skill than I do.
Nope, couldn't care less. Fender isn't the be all and end all by any means. In fact, IME the vast majority of their product is mediocre at best.
... However, the market for Fender is much greater. It's brand recognition.
Please do not be offended, as I mean no disrepect, but what's custom about it? The paint job, perhaps? I mean, people put Jazz necks on P bodies all the time. I used to do it regulary until I finally came to appreciate the P width.
Seriously, I'm not trying to start anything here, but I fail to see anything 'custom' in what appears (to me) to be parts basses.

By the way, the logo looks fine, with or without the URL.
And that's the crux of the headstock matter and why Fender is well within it's rights to defend their trademarked designs.
It's not like any of those using the Fender headstock are actually a Fender but they sure try to look like them.
Yes, the non-Fender instruments could be very well be better than a real Fender but I'd think a proud assembler would want to have his work instantly identifiable especially if it's better than the product it imitates.
Are you inferring that an assembler with NO pride uses the Fender blueprint to offer basses with colors and other various options that Fender doesn't sell?
At first that didn't make any sense to me but now I think I see where you're going.
Color or features has nothing to do with what I posted, I'm addressing the point about using Fender's trademarked headstock shape. Maybe it could also extend to body shapes and pickup layouts but those aren't trademarked so they're fair game even if copying them because "that's what sells" is kind of "me too".
Right off the bat, it's an ash body in Lake Placid Blue, definitely a custom spec. The vintage Fenders were alder with ash being used only for the so-called "Natural Ash" finish of the 70's. Alder is the prevalent wood in modern Jazz and Precision shaped bodies today as well.
so I've said my peace here, and am moving on ... Dan is now fully aware that he should seek bonafide legal advice for his business to determine what is legal for him to do with respect to Fender's trademarked materials. should Fender come knocking, he'll get to learn the other side of selling a product that infringes upon another entity's trademark

Good luck with your legalities, and try to do whatever you can not to change the headstock shape - to me the Fender style headstock is the perfect fit for these types of basses. A guy like me who can't afford a 63 P bass, could surely come close with one of those P's you have on your website for a serious fraction of the price! I'm loving that sonic blue! Well, it's not like I'm treading into uncharted waters here. There are other builders, much bigger than me, who've been doing this for years and have sold hundreds of instruments. Fender hasn't made them stop. I'm just doing something other guys have been doing before me, with a slightly different twist.
