Should I get an attorney?

Look, I'd be down to throw in $5 or so to help cover shipping costs for you to get your gear back, but Stumbo raised a good point. The issue was first brought up in Oct 2009, and then I saw the resurgence of the thread in late Dec. 2009.

Shawn, what actions have you taken in al that time? I did read that you recently got in touch with the singer and all, but it seems like they dicked you again...

Bottom line, do you have a way of getting your gear out of wherever it may be located and into somebody, anybody's, hands? If so, Im sure the kind folks at TB would be willing to pitch in a few bucks to get your gear shipped back, especially after reading GE's thread and all the good that came of it.
 
To clear up a few things. I'm in Illinois. My gear is in a storage space in Louisiana. The band is in New York recording. 12 Stones is an LLC, based out of NY (where the label is). The manager is in Appleton,WI. So yes, this is a geographical mess.

My old bass tech, grew up with the singer and has been their instrument tech for years. He is the one that has the key to the storage space, he would be the one I would have to contact if I went down myself or if one of you guys went down there. Nothing was done from October till now because he was out teching for another band, so even if I had driven down there myself or offered to foot the shipping bill, there was no one to unlock to storage space. So it was virtually pointless to do anything really until after the holidays, when he'd be home.
 
Stumbo;8498313 Note: The OP was in October of 2009. Seems to me that you possibly could have saved enough by now to pay for shipping the rack back to you by now. Also said:

Without going too far into my personal life to make it all make sense for you guys, this last year from a financial standpoint, has been the absolute worst in my life. I have bills up to my eye balls right now and they're only climbing. I didn't work from January-August because I was being strung along by these guys doing one-offs and being told tours were coming and ****, so by the time they canned me and I got a job, which was in October, all I could find was seasonal part-time, Not even close enough to cover my bills. Go check the for sale forum, I had to sell my Warwick 5 and I'm on the verge of selling my 400+, just to barely pay my bills. So in short, No...I didn't have any money to save up and cover shipping. I'm still in debt, still broke, and just lost my job....I'm only getting more and more into debt. I've said it before and I'll say it once more, if I had the money to cover shipping...this would be a non-issue and my rack would have been in my hands months ago.

Times are definitely tough. There aren't any good jobs anywhere that I can find either.

I think the only thing that really bugs me about this story is the fact that your gear is being used by someone else. It would be one thing if it was just in storage somewhere.
 
Well there's some positive news... good to know this is only a matter of somehow coordinating with people from various parts of the country.

It would be way cool if management or someone on that end could ship the stuff for you, just to be nice.

Good luck getting your stuff back. I'd be hopeless without my rack!
 
So if you're tight with the tech who is on the ground with your stuff in Louisiana, and if you think he'd safely pack your stuff for you, why not come up with a shipping estimate via DHL, FedEx, whomever, and perhaps that's something we all on Talkbass could give you a few bucks for...

If you can figure out some way to get the rig to Myrtle Beach, SC on Tuesday the 12th I'll happily drive it all the way out to Rockford.... I live in Crystal Lake.

I'm driving down there on business tomorrow and I'll even have a trailer. Seriously, if you can work it out I'll at least get it from SC to Rockford.
 
I feel for you, but things will never get resolved until you decide to do something and follow it through. You have some options:

-Contact the people with local connections who have offered to help, see if something can come from that.

-Borrow some cash to pay for shipping: then you will have your gear and can sell off the stuff you were planning to to pay back the loan

-Ask us for help: hard to do, but a few have offered, and I'd kick in as well to see this mess resolved. You could ask for small donations or a bigger loan until you get your stuff and sell some of it.

- get the tech to get the rig out of storage and ask a local TBer to hold on to the rack until you can afford to ship it or pick it up, or until a TBer is driving up to you, etc.

Forget the lawyers, the small claims, the witch hunt, etc. It's obvious you haven't the heart or the cash for either, and the outcome is not in any way sure, so just forget those option.

But I can't stress how important it is for you to initiate something. You're waiting for something to happen but it won't. Wait longer, you'll be out your rig, and the ability to respect yourself. It's demoralizing and paralysing to be broke (I've been there), but you've been offered help, so take advantage of it or decide to write the whole thing off.
I'll be pissed off for your sake if this thread is still going in a month, unless it is to report a happy conclusion.

For those who haven't read the whole thread, the OP is getting a raw deal from the manager of 12 Stones and the band doesn't seem to have enough stones to do the right thing either. Maybe a little more bad publicity will help the suckass manager to swallow the few hundred bucks to get the rack back to the OP like he should have done from the get go.

BTW Shawn, you're still listed as the band's bassist on German Wiki.
 
Just a thought...

If you're going to sell this equipment anyhow, what if you contacted a music gear seller in the area where it is being held and consigned it to them to sell on your behalf. Quite alot of gear to sell, hence a good commission, hopefully the dealer may even pick the equipment up.
Just a thought anyway.

BTW What happened to the singer and guitarist? Thought they were going to see to the safe return of your property?
 
I feel for you man, but I've got an idea.

That Avalon U5 you've got in your rack would sell used for $500 used. Sell it to one of the guys following this thread at a discount say $350. Have that money sent directly to your tech friend who can pick up the rig, pull out the Avalon and ship it to the buyer and ship your rig back to you. $350 should cover all your shipping costs and your tech friends time.
