been there done that, i hada manager whos ass i beat for completely skimmin off the top of our pays, and by skimming i mean he dropped a fricken ladel into the pot thats about the size of our pot and left us the dribble

but i was in jail for two weeks due to me causing all that damage to him, although we eventually got our dues

I've re-read through this thread, and the only two solutions that make sense at this point are:

1) Calling the local police and reporting the gear stolen.

2) Driving down to where your gear is stored with a crowbar and other implements in hand.

Okay I agree court is the best way one other way I thought of if you give us all here a at talk bass the email we can all email the manager and say we are friends of yours give him back his stuff after the first 1000 or so emails hit his box from bass players all over the globe he will know you have a lot of friends good luck

while you were playing with the band did you make any friends at the labels office? i work for warner music group and i can tell you when you go above a manager the label gets beyond pissed at the manager. if you know anyone at the label i would give them a call, youll probably get your gear back in a few days.

I have some mutual friends of the band that live in Memphis that are going to their show this weekend. They are going to grab all the rest of my stuff and take it to their house. So atleast, I know it's not being used and it'll be 8 hours closer to home. I haven't spoken to any of them, band or manager at all. I knew I would have to just figure this all out on my own, when I could and that's what I did, for lack of better options. So, by the end of this weekend my gear will be safe at a friends house in Memphis, and when I have the time and gas money to drive down, I'll go grab it.

I think you should send the manager and the label an invoice for your gas money and "rental" of your equipment when this is all done. At least it might put some much deserved at the manager.

After receiving that e-mail I call the singer and both guitar players, no answer from any of them.

10 minutes later I got a text from the singer, saying what's up and sorry he missed my call. Told him we needed to talk. He called me about 10 minutes later. He's making it a personal issue to see that my rack get shipped back to me.

I actually have no idea how much it weighs. It's a 14 space shock rack. It's got a power amp in it, Avalon U5, rack tuner, power conditioner, rack shelf with my wireless receiver on it, 2 space rack drawer full of cables, and a dbx 131. Over 100 lbs I'm sure. So guesstimating on the shipping cost would be exactly that, shipping could end up costing way more. also, I'm pretty sure it would have to be shipped freight on a pallet because of the size/weight.

Freight shipping would cost you less than gas would. Have your friends measure/weigh your stuff and get a quote.

It being a rack it can handle truck transport. I'd bet it'd be less than $75.

You might find it is cheaper to just suck it up and pay the shipping than to persue "justice." I just went through this with a new house. Builder didn't finish. Breached the contract. My choices:

1. Suck it up.
2. Pay more in legal fees than the builder owes me in damages
3. Hire out the work and sue in small claims court to mitigate it.

In my case, lawyer fees and court costs are not recoupable even if I win and the builder is in breach of contract in my state.

Oh well.

I would pursue the stolen angle though. Once that gets going, you might agree to drop the charges in exchange for the safe return of your gear, and fair compensation for its use, and the money owed for the unpaid gig.

Yeah there arent all those lawyer jokes about sharks etc for no reason at all...
I just had a dispute with a church gig that i did for 3 years.. they owed me almost a grand .. and did not return letters or calls..... i had to use a lawyer to craft a letter to get me what they owe me... ughh lawyers and churches are the one place you're sure to get screwed over at.. ughhhhhhhh

I just got back home. Left Rockford 3pm Friday, got to Memphis just before midnight, crashed on my buddys couch, got up and ate some food, left Memphis about 10am.

My rack is back in my possesion!
