I guess I missed the full discussion, but how does the 17 count as child porn when the age of consent can vary between 16-17 in some states? Is it considered ok because it's private event and not turned into media?

But the grandparents can help out with the kids since they are only in their thirties
Not really addressing that specific issue, because I have zero experience with anything like that (thankfully!), but I feel compelled to comment that people online somehow always tend to jump to a bunch of reasons why a registered sex offender might just be the victim of a long complicated set of coincidental unfortunate circumstances. Which I find funny, because that's almost always how registered sex offenders describe what got them convicted. I was in that exact situation as the person who made that thread, but the guy got arrested and convicted while he was in the band. I only found out because he told me he was going to jail, gave me this long complicated sob story about how it was all a mistake but he couldn't prove it and just had to plead no contest and asked me to lie to everyone else about it (say he had unpaid parking tickets). Turned out his sob story that he to cover up was a lie itself (a few friends and acquaintances in law enforcement looked him up) and after some digging I found out the charge he was convicted of only applies to repeat offenders and he had been convicted before. Then A LOT of odd stuff about him and vague stories about his past started making sense. For years people I knew still socialized with him and would go through phases of giving me these long, convoluted stories about how everyone is "talking sh*t" about him and it's all a misunderstanding...then something happens and eventually they distance themselves from him. Sexual predators LOVE to cast themselves as the victims of unfortunate circumstance and witch hunts.
I think there is some logic to it. The child pornography laws were put in place to stop the actual production of child pornography. As someone under 18 can't enter into a legally binding contract I think the law was designed not only to protect children but also teens who could be exploited. Since the time the laws were put in place things like the internet have changed everything. It also seems that judges and prosecutors try and prosecute everything to the fullest extent so that loopholes don't occur. That is why they prosecute teenagers (under 18) who have pictures of other teens under 18. Otherwise some scumbag would have teens take pics of other teens and setup a website claiming only teens could look at it or some other sick thing.
If you wind up in jail over this stuff then you probably did something wrong (probably). The other thread the guy only got probation or so he claims. If that is true then it sounds like it wasn't something that bad. That is why I said that guy needed to find out more. On the other hand, your name is going to be connected to this guy online and that is not a good thing. That alone would make me walk away.
You would be surprised how little punishment people get for sex crimes. Besides the fact that it can be hard to prove when it's just a victim statement (sadly), a lot of times people take a plea to lesser charge rather than go to trial for the crime they actually committed. On top of the fact that there's a lot of sexual predators that get caught right BEFORE they were about to do something awful, which is good in a way, but makes it a lot harder to throw them behind bars. The guy I was referring to spent all his time behind bars for probation violation, then violating the terms of his work furlough, then parole violation for THAT. If he hadn't had been such a consistent f*ckup, he would have spent virtually no time behind bars. I found out the previous offense that happened before we knew him, he got house arrest for. All that on top of the fact that he did more stuff he never got arrested for, that people just blew off as him being inappropriate or untrustworthy and not a criminal.
Sorry for the rants. Not a subject I want to have up close experience with, but unfortunately I've seen how the sausage is made now, so to speak. It's also really hard to get to 35 and not know A LOT of people who have been sexual assaulted/abused and then realize how little the people who perpetrate it actually get punished. A lot of the excuses and explanations get really familiar, same as any group of predatory/abusive people.
I do agree that these laws are enacted with best intension in mind but I don't waste time with why this and that details. Especially the differences from one state or district to another.
Good opportunity for headache if you ask me.
We've had this long time family friend via my aunt and uncle, who found out was convicted of like over 30 counts of child porn, some were dropped (court stuff is always dropped as most end in pleas) but what he was still given amounted to never getting out again...
Really weird because he hung out with my family as long as I can remember, but he never did anything and was a cool guy actually so it's weird and only a handful of us know about it so we told the rest of the family he got a really controlling girlfriend and she moved him far away.
Just to pose the argument it would be really sad if these people are wired this way like those born the wrong gender. If that's the case it would be terrible to be wired to something guaranteed to destroy your life.
Glad I like ladies, and comforatable to stay above 20, I don't get to face these problems... Unless I have a daughter someday... That guy in the other thread said don't read your teenage daughters texts unless you want to always be scared haha.

Well our search for a lead singer has officially begun. I'll be really, really surprised if we find someone that meets our current singer/guitarists exacting expectations. It's a pretty small town. He basically wants someone that sounds exactly like he does - which was/is pretty unique.
Not to mention the whole bringing in a 4th member thing. Dynamics will change, things will be disrupted. I tried to press the point that a singer will want to have some creative input, and his/her vision may not exactly line up with what we've been doing so far.
I really hope it works out well, but I'm not excited for this change at all.

That is crazy that people get off with house arrest for this stuff, but it is as you say difficult to get hard evidence (other than an actual rape kit kind of stuff). You are right it is crazy how many people have been abused. To me it is just such a complicated topic because on the one hand we want the strongest laws possible to protect people who can't protect themselves (in this case children) on the other hand there are so many stories out their of people being labelled sex offenders for life for things that weren't abuse/rape. I mean if this guy is really a predator well screw him, but it sucks if he made some stupid life choices and now has to be branded for life. Either way I wouldn't be in a band with someone like that because I can't be associated with someone with that hanging on to them (not like many people can be).
Why he not want to sing? And are you a fan of his unique this or is this an opportunity for positive change if you can swing it.
Every time I see a thread like this I get really worried about the mental state of a lot of people on this site. There's a dude that frequents that forum who has a quote along the lines of "a false rape accusation is a thousand times worse than any rape that could've occurred." People are way too quick to apologize for rapists and pedophiles on the internet instead of just calling it as it is. (For the record on that quote, less than 3% of rape allegations are false or unfounded)
Trying to split hairs between pedophilia and child molestation is dangerous territory. I think when it comes to predatory sexual behavior it's generally less about sexual attraction and more about dominance and gaining a sense of power and self by what you do to someone else. Rapists can be straight or gay, but rapist isn't a sexual identity in and of itself. It's also virtually impossible to separate child pornography from child abuse. If someone is "just looking" at child porn, someone had to be exploited or victimized to generate it. If it wasn't the person viewing it, they just created a demand for it and create a sort of tacit endorsement of the crime that's being committed. It's like blood diamonds, nazi gold or stolen merchandise. I suppose you could argue there are people out there who just look at the kids section of clothing catalogs and dream about innocent, romantic feelings, who have no intention of trying to seduce a child. It just feels like a long path away from the reality of most of the situations and trying to come up with convoluted explanations for behavior that's generally pretty simple (but unpleasant) to explain. To think that's the person everyone is talking about when they say "registered sex offender" would be a huge miscalculation. It's possible, but not likely or anywhere close to the average.
I know there are some real people out there who have actually been screwed over by circumstance. The kid who just turned 18 and his 17 year old girlfriend's dad has him arrested is a popular story. I just don't really think it's common and at this point I've learned to be suspicious of people's bullsh*t stories. Every wife beater, child molester, thief or just lying crappy friend has these stories about how everyone screwed them over and it's all just a misunderstanding. You hear enough of them, they all start to have the same ring to them. So when people online go on and on about all these stories that happened to them (or usually a "friend of a friend" or "cousin" or "guy I know") my b.s. meter just starts hitting into the red.
