thats why we'd bring in an accounting firm or make a random number selection program.
doing the winner selection in a double blind experimentation methodology.
Us not knowing what numbers you have until after the drawing so there can be no bias-

I just got screwed royally the LAST thing I'd want to do is screw anyone else!!!1

Well if you collected a total of $5k the paypal fees would only be $145.30, that still leaves a balance of $4854.70...

Another thought was to sell as many tickets as you could, then after you recoup your $5K you can give the rest to BigMikeW's musicians fund charity...this way there are many winners...someone get's a great bass, you get your money back and those who didn't win get to feel good that part of the cash collected will go to other musicians in need.

It all seems to be shaping up nicely.

Can I suggest, once it's all up and running, that talkbass sends out a blanket e-mail to all members so that anyone who might be interested doesn't miss out on this oppurtunity.

I got 25 bucks I am sure to spend on something idiotic and that won't work, might as well give it to you guys.

Oh yeah, and I play the lottery occassionally, so this is about the same. Let me know what happens.

As for keeping it just to TB members, is it really bad if someone's grandma puts in 25 bucks and actually wins? Given this story, are we SURE that this legacy needs to remain in TB boundaires? As for scammers, if they pay 35, what is the issue?

All I am saying is, sell 200 tix. Why does it matter to whom?
 
You advertise on 3 or four musicians sites that your holding a raffle for a 5k bass for 50 dollar tickets, I think you may be able to sell a few more than 100 tickets :) I'm down 100 percent, a chance at a beautiful bass like that for 50 bucks is too hard to turn down.
 
This is an unnaceptable scenario. You are a much better man that I am....

I had the OPPOSITE experience with Mike Kinal of Kinal Basses. I'd like to plug him and his company as being quality with a capital Q. I had a bass built by him that had every peice of wood hand choosen by me (over 7 different types of wood used on the bass) with custom electronics and the bass came to me EXACTLY how I pictured it in my mind. It was precisely what an experience with a custom builder should be. And you know what? It cost me less than quite a few mass produced basses (just under $3k) He even gave me a Tshirt and wrote me a personal note congratulating me on graduating (the bass was a grad present).

I like the idea of having the rest go to charity, but

An accountant would probably not charge very much to handle this. To keep the winner totally random, we could have them maintain a numbered list of the participants, and then another party could run a random number generator program to select a number in the range. (I could do that, I'm a programmer).

If TB is not agreeable to running it here, we could set up a quickee/cheapee website to manage the raffle. That would only cost a few bucks.
 
OK, i've been doing some research on lotteries and their legality. and i've come to the conclusion that its probably a wise idea to speak to an accountant and a specialized lawyer concerning this matter.

lotteries are generally regarded as a form of gambling. adding to this mess further is that from what i can surmise, this lottery will involve "lottery tickets" sold to people in multiple states, therefore making this an interstate lottery. as such, this bass lottery will be subject to numerous state and federal gaming laws. not to exclude those TB'ers from other countries, but god help us if we try to sort through running a legal international lottery.

Use of the USPS is out of the question, as they specifically ban mailing of lottery tickets or the like. punishment for breaking this law is a maximum of 2 years in a federal penitentary.

Now, this lottery will most likely be held online, and subject to the laws of the state in which the lottery originates. This is simply a guess from the other information i've recently read. i cant seem to find any real documentation regarding the legalitites of online lotteries.

i'm educated as a physicist. I have no business trying to interpret any laws but the laws of nature. i'd recommend finding a good lawyer trained in gaming laws. or maybe call your state's gaming commission for more information.
 
i know what you mean, dmb. i didnt even think of the gambling factor until i started doing the research. and from there, all sorts of cans of worms started opening up as i tried to think about what exactly will be taking place.

the one loophole with all of this is if the money collected goes to charity. this might afford a bit of legal protection. but in this case, i would assume that the bass needs to be donated w/ tribal unable to recoup his donation (sorry, tribal). i'm not totally sure.

just throwing out another idea. maybe something worth looking into.

What they did with the other raffle I mentioned was to pick a daily lottery number for a predetermined date. You find one that generates 1000 numbers (for example) and if there are 200 tickets, you assign 5 numbers to each ticket.

The winning number is publically available on a website so there's no (reasonable) chance of shenanigans.

Drawing the winner is the easy part. It's the legal and logistical issues that are the difficult. Oh, didn't the Feds make online gambling illegal a few weeks ago? Lol. :D
 
what about " donations"?
to the websight for the "bad luck" I know theres trusts set up pfor the less fortunate all the time but this is obvoiusly different trying to compensate me for getting screwed.


how do they do this with pledges etc? they give out some sort of compensation for the pledge, maybe we can give the bass away as the pledge end prize but theres the determination of a recipient problem to not do this as a raffle or lottery.

with all of the donations?

or buying something small and there a " millionth buyer type giveway at the end"

how can we do this to not make it a lottery and still be legal and fair?
