Remember that Oprah car giveaway. Some of those #####s actually griped about having to pay taxes on the free car they won. Sell the car below market, pay the taxes, end up with more money than you started with. Take that money, find a cheaper car and end up with a truly free car.

To me the difference between a lottery and a raffle is that in a lottery there is no gaurantee of a winner.(megamillions is not won every drawing, that is how the jackpots get so high) In a raffle there is a finite or infinite number of tickets and there is always a winner from that pool. In a raffle one person is going to win.

You can have some legal jargon with a no-contest clause, like in a will. If anyone contests the outcome they lose their right to participate in the first place.

I can't play the bass I currently own that well, but I would buy a ticket or two just for the chance. Hell, I have spent much more money in a topless bar and have nothing to show for it. This is a awsome way to help Tribal have a little closure on this and someone get a awsome bass.

I just asked my dad (a lawyer) and he say that he isn't completely sure because this isn't his branch of law, but most likely it would have to comply with the laws of all states that have participants, that is why when some stores have promotions, they say things like "residents of california and texas not eligable"

I saw the bass in question this past weekend at the Arlington Guitar Show. I can't comment on it 'cause I didn't even pick it up. I asked Brian about it 'cause I thought it looked familiar. He told me it was the Bebensee from Talkbass. Just saw it, that's all.

There has to be some loop-hole for online raffles. The reason I say this is, there are thousands of online raffles that go worldwide. I know that some of these did not take into account all the laws of the land.

It looked OK from where I was standing. It caught my eye. I didn't pick it up and give it the once over though.

I played this bass for a minute or so at the guitar show this weekend. I didn't plug it in so I can't speak for tone, I didn't feel compelled to. It was OK at best. Not worth the money at all IMO. I did like the narrow string spacing though. With all the Benavente, Smith, Daniel Fernandez, MTD and other basses there, it was pretty much outshined by nearly every other bass that I picked up at Brian's booth. I've played basses by much more inexperienced builders that looked nicer than this.

Sorry, no intention to hijack but a couple pages back several other ppl talked about their experiences with other custom builders so you wouldnt right off the idea for good.

I was just trying to share my experience with one that was much different than yours.

If a charity had $5,000, why would they buy your bass, and then take the risk that they couldn't sell at least 250 raffle tickets at $25 apiece?

Just let Brian sell your bass. This isn't a charity type of issue.

charities are nonprofits. but they still have employees and expenses.

How charities work is:
they either do grass roots and beg (salvation army)- but they also have their retail outlets.

or they auction items for far greater than thier worth.
I used to enter raffles for jaguars and boats etc. these items werent "donated" they were bought and sold by the charity.

thats how that scumbag from united way embezzeled millions

the charity buys the item say at $5000.
that sell $30,000 worth of tickets for that item because the average entrants only spends $25- $50 for a multi thousand dollar item. (many charitiy raffles dont mature until they have sold X amount of tickets)

the charity makes $25000 and of which a percentage goes to the relief effort they are trying to achieve which can range from 80% to only 2%!
thats how charity workers make thier living and profits for the offshore ones

so now thats clear does anyone know of a tb related charity that might be interested?

When a charity raffles or sells items for profit, the item(s) are usually DONATED TO THEM. In the case of the Salvation Army or Goodwill, those items are DONATED by individuals. In the case of more substantial items, like trips, cars, etc., those items are donated by corporations. How do I know? Well, my wife and I have been involved with numerous charities over the years. Through work, I have been on the board of two different charities. All of them have been involved in "non-begging" related fund-raising. One of them even raffled a car, but that car was DONATED by a car dealership. Most charities can't afford to purchase expensive goods in the first place, much less risk taking a loss on a specality item like a KB bass. That, my friend, is how a true charity works.

You want a charity to buy this bass from you, at "cost", simply so that you can get out from under it. You want them to compensate you for a bass that you admit is substandard. That sort of spits in the face of the meaning of charity, doesn't it?

I have been following this thread, and I am truly sorry that Ken screwed you over. How's your legal action against him going? What steps have you taken to ensure that HE will compensate you for your perceived loss? Does Brian have anyone interested in the bass? Do you think that a thread describing the inadequecies of this bass is helping his sales efforts?
