A local TB'er ripped me off!!

Yer he described his turning of the nut as normal and not stiff. A bold faced lie, if I have to say it frankly.

It is feasible that he was able to turn it, perhaps not reasonable. Anyway, I know it doesn't seem like it but I am on your side. Even if this guy honestly didn't know that there was a problem...it seems that there is in fact a problem. The problem is, this guy may not believe you are being completely honest either, that is a two way street.

Unfortunately it is just as believable that you broke the truss rod yourself that he is lying about his experience. It really is your word against his. That's the dilemma, who is to be believed? Both of you are long term members in good standing. I hope you both find the right path to resolving this.
 
Sir, I have the seller's paypal info, name, address, and phone number. As I do not wish to have any kind of physical confrontation or give the seller any cause to get a restraining order, I'm trying to do this in a legally proper way.

And I never suggested otherwise. If you have all that stuff then act on it and all will be better soon, right?

I know it is a lot more fun to bicker and argue on the interwebs, but could somebody, oh I don't know... GET A FREAKING QUOTE FOR FIXING THE TRUSSROD ALREADY AND MOVE ON!!!
If the OP would get a quote and just ask the seller if they would split the cost of repair everyone might be close to a resolution by now. It seems like the OP would rather slander the seller than actually work on finding a peaceful soloution.
 
I know his name, phone and where he lives. I've contacted my cc company as well as paypal, and if paypal uses the aforementioned loophole, my credit card company will cover me.

Ah, good. If you funded the Paypal payment with your credit card, your CC company will make things right. And then Paypal will charge the seller a $20 fee for the privilege of his account having a chargeback.

You may want to calmly explain this situation to the seller - if your CC company is involved I don't see how this is going to end in any way other than you getting your money back. If he refunds you now, he can save himself the chargeback fee.
 
If you made the purchase through Reverb's system, then the negative feedback should be removed from this site.
As much as it pains me to say it, I think you're correct. The OP had a choice to buy from TB classifieds or Reverb and chose Reverb. The OP had a choice to do the transaction via mail or in person, he chose in person. Neither of those choices are necessarily wrong but each has a proper method of issue resolution.

Did the OP get shafted with a hidden defect? Sure looks that way.
Did the seller disclose that the truss was maxed out, rusty or broken? I don't know, I haven't seen either the TB or Reverb classified ad. But based on the OPs postings in this thread I'm going to assume it wasn't disclosed.

So from the side of the story we have so far, it looks like the OP was shafted by a schmuck that feels he can get away with it. The recourse for the OP who purchased the bass in person as a response to a Reverb ad would be to personally visit the seller and request a full refund. If the seller refuses, it should be followed up by a written letter or email outlining the issue, the sellers response and one last request for a refund before it goes to court. If the seller still refuses, it's off to small claims court where a judge can determine the merits of the case and if there was any misreprentation of the product.

Had the OP bought on eBay with PayPal via mail or on TB with PayPal via mail the recourse would be very different and probably with a better outcome. As it sits right now, I'd say the OPs chances of success in small claims court are slim unless the truss rod was specifically claimed to be in good working order.

We haven't heard both sides of the story (and there's always two sides) but right now I feel very sorry for the OP and I sincerely hope he is able to resolve the issue to his satisfaction. What a horrible way to start out the new year.

On the contrary, I just found out that it's $250 to replace the truss rod, $325 to replace the neck. I'm not crazy about replacing whole neck, its a 2003 Korean, with matching color on the headstock. Believe me, bickering isn't good for my blood pressure!!
 
So, what's going to happen here?
It reads to me like the OP might end up with his money back, but still retain ownership of the Lakland.
I agree that the previous owner (seller) should have made it right, but taking back the money & keeping the bass is just as wrong.
Whoa, who said anything about keeping the bass and getting a refund? Let's not invent rumors. I fully intend to give the bass back in exchange for a refund.

Good! Ask the seller if he will refund you $150 in exchange for positive feedback.
 
Seller is a serial flipper - nothing wrong with that. They (serial flippers) check the overall condition (scratches, dings and stuff) but they don't go deep in their investigations. To make money, you need spend the less possible on the item you're flippin'.

Best way to resolve this is the seller pays for a new neck, that's it. It'll teach him a lesson, too. Both parties will be happy after that and in a couple of days - because people forget quickly - all is gonna be well and the happy buyer will play his newly acquired bass, and the seller will keep flippin'.

Seller has refused to cooperate. He knows where this all sits, he could tender me some kind of offer, yet he has not. I'd probably just get angry if I contact him again, based on his refusal to cooperste in any way thus far.

that's really sad and messed up ... but i'll still trust folks around here on TB .! more than Ebay , Reverb , CL , etc ...

I've had good and successful dealings here in the past, and I won't let one bad experience foul the good.

This thread has immortalized him as a seller, if he ever wants to sell anything on TB again he has to make this right, but you just finally got a quote, send him a private message saying, "Let's work this out, I want to keep the bass, but it's going to be $250 to fix."
Seller shouldn't have sold it with "pro setup," in the description which we now know was a total lie, or at least misleading since he never had the bass setup. I guess he meant that it played like it was pro setup, but it is certainly a dishonest/misleading way of wording it.
 
Thanks for your good wishes, freq. I still have a line into his Reverb account, he hasn't disappeared from there at least.

I wonder if even Lakland can repair it. It doesn't offer any access except in the broken end, and I can't see how to remove it.

If the fretboard and the neck are made out of different woods, it is possible to unglue the fretboatd, put a new truss rod in, and glue it back. It s a big process but not impossible

This is complete speculation...it is not a foregone conclusion that the seller is lying any more than it is that the OP is telling the truth. Just because one is screaming louder than the other doesn't make their position more credible.
