Rybski Basses?

I don't mind if somebody wants to say something, then say it. It's cool with me. However, you don't tell me when to shut up. May this thread live forever, or at least until the guy pays me back.

I never told you to shut up... maybe you're having a mixed position on my view or something but I do hope you get your money back. At some point the realist in me comes out and says to actually act on your hardships. I'd imagine you should do that because, remember, you chose to deal with a business that presents zero policy on returns, rescission etc... so in that case I'd think the best thing to do is call a lawyer and explain the story. I can try to help you out with everything I know about business law, as I already did offer up some previous advice and scenarios but the best bet is to get with the right people that specialize in that specific field for that specific location of business.
 
It's a great thing we have the internet... who needs to cry home to mommy or call the po-po.

I'm sure the guy will send the money and he's allowed to think whatever he wants about whomever. So hasn't he been bashed enough at this point? Why is this thread still here?
Dude, compared to what you said in the post above... "shut up" would've been less condescending and less antagonistic.

I said I would let everyone know if it didn't come in. It didn't come in. You did in a way tell me to shut up. Don't get me wrong, I'm not mad at anyone at TB be. That would make no sense. What I chose to do and say is up to me. I think that everyone who wants to say something should no matter what it is. All the others as you pointed out and accused them of riling me up by getting ahold of Rybski are just doing me a favor, and I thank them for letting me know what this guy is up to. The only person that I am mad at is Rybski. So I'll cry boo hoo just a little bit longer. I thank you for your advice but it is not nessicary. I have studied the law for Tennessee and as soon as my documents come in the mail I'm going to take action.

like I just posted. He dealt with a company that doesn't have policy on anything so he should know by now that if he wants his money back, then he needs to do the right things to get it, legally.

Now if I told you to shut up, it'd be for your own good. Any competent lawyer would say the same... "don't say anything until court"

Since you've studied law, I assume you know these things. Keep calm and settle it in front of a judge.. that's all I'm trying to get across.
 
Just so everybody understands exactly how I feel here it is. Post whatever you want. Say what you really feel. My money has already been taken. It's nobodys fault here if I don't get it back. If you are just using this thread to get your kicks or sluff off at work, great! It doesn't bother me one bit. I encourage you! All of you! Posting here is not going to hurt me or damage my chances in any way shape or form. More than likely I won't even have to show up or drive to Tennessee to prosecute this man. I've already looked into it. However if anyone wants to suggest that I shouldn't be aloud to post that person better be a staff member. This is my thread.

Good point. I guess it would work that way with a reputable builder or business. Money returns should be noted in a contract... something like: "If you cancel this agreement within the 3 day rescission period, monetary returns will be issued within 30 business days" That's not an uncommon scenerio.

There is not a written contract though, its verbal I guess. Either way, a verbal contract still would carry out the contracting laws so I would imagine that the defense would actually argue the 3 day right of rescission. Meaning that, there was a contract, there was ordering on both parties... there was a delay in work based on the client, work then did actually start at a later date and then the client cancelled the order.

I guess based on all the posts that's the general idea of the situation so at that point any right of rescission has long been over. There's alot of angles here but it basically falls in the lap of a judge. On any given day he could swing either way. He could feel bad for the client or agree with a defense story or split a decision right down the middle... who knows
