Love the “won’t” lower my standards” to respond to a complaint. That’s just bad business practice even if you're someone whose nose is up in the air.
I stated I was not going to lower my standard and trash talk the buyer Sir.
 
Slander, defamation and libel are very difficult to prove in the United States. If this were happening in the United Kingdom, for example, it would be a different story. I’m not an attorney but I would lose no sleep over it. You are mostly likely in the clear.

Skip the drama. Enjoy the bass. You will probably live longer this way.

You may be mistaken about slander defamation and libel in the United Kingdom . For one thing, we call it defamation rather than slander. You may or may not be aware, but reforms under David Cameron's Conservative government a few years ago redressed the balance between freedom of speech and right to litigate over statements made in public realm.

The long and short is that our law is now very liberal when it comes to freedom of speech, so far as defamation is concerned. Firstly, damages must be proven real and not imagined, which is difficult to quantify and prevents bully-boy tactics of exorbitant claims for damages as a means of forcing silence. Secondly, the courts are now in favour of defending the rights of an individual in exercising freedom of speech over the rights of a company or corporation to buy silence through threat of litigation.

There is more to it than that, but the gist of it is that this area of law has changed massively in the past decade and comes out in favour of the individual.

Shame to read this story involving a Surine. I adore Surine basses and wish I could be lucky enough to own one myself. To hear that a NBD has been spoiled is disappointing. I hope all parties involved can find an amicable resolution.
 
I originally PM’d the OP out of solidarity because I had a very similar experience with Bass Southwest but after having a chance to read through this posting I feel the need to corroborate his story publicly.

“I had a very similar situation to yours with Bass Southwest. EBMM BFR Old Smoothie. Had a very fine delamination between the skunk stripe inlay and the neck up around third fret. Nearly impossible to see, but you feel it immediately. He also claimed that it was cared for and set up...BS...the fingerboard was dry enough to start a fire and every single piece of hardware that turned needed lubricant. I didn’t get anywhere with him or Reverb on settling the problem. Ernie Ball wants $1200 to replace the neck and you don’t get to keep the original because it’s proprietary lol”

BSW actions on this thread are also in keeping with what I experienced during our previous interactions

Edit: I forgot that the “original mint OHSC” had a Musicman logo (plastic right by the carrying handle) on the front that was so wrinkled up it looked like someone had taken a heat gun to it

OK @BSW we can see a spot as pointed out where the finish appears cloudy, perhaps lifted, right next to the end of the fretboard (i assume that is the TRC there?).

IS THIS THE SPOT the buyer was talking about? And if so, did he see this photo before buying? That’s easy enough.

And then you can address the warranty question.

And then we will all have our answers and can shaddap =0)
 

It also says it's feedback left "by You", which would suggest it's feedback left by BSW not the customer. Perhaps BSW leaving feedback for for someone ... or for himself? :eyebrow:

Unless the customer's username is "You" and he writes feedback comments in a style identical to BSW's posts here... and was happy with a completely different bass & transaction.

This is nothing but false and misleading information buyer this buyer 100% false and misleading. I don't use TB much but was made aware of this by another TB user. Although this was posted in 2005 Im now seeing this and will not lower my standards to trash this buyer. I can say that I have sold basses world wide and never had any issues. This buyer unfortunately had buyers Remorse after buying a hand build boutique bass. If any one has any further questions feel free to email me at [email protected] Thanks to all of you

Wow..this thread has evolved.

Just my opinion, but a clearer understanding of the situation and perhaps proof of some kind for clarification.
1) A copy, ad listing or sales post of the initial purchase by Bass SW from Surine that states the bass sold was USED and some mention of the flaw (s), purchase was to the Bass SW as a retail buyer rather than a reseller so the warranty would not transfer to the eventual customer.

2) A copy, ad listing or sales post by Bass SW from the OP(customer) that shows the verbiage and mention of the bass as being NEW with no mention of flaw and warranty conditions (if mentioned).

To me, just providing these would help the TB community have a clearer idea of where the truth may lie, who has more of the credibility in this. I don't know the OP, I don't know Bass SW, I don't know Surine.

Also have to mention, looking at that picture above, with the circled flaw, is it just me, but I see some other noticeable flaws on the bass just in that shot (who knows what else is on the rest of the bass), look at the uneven gap at the top. Also notice the screws, in particular, the bottom one. It's pretty crooked. Was this kind of flaw from Surine or after purchase? If it came this way, I'm not really impressed at the QC especially for that price. Begs the question, why didn't Surine repair the flaw before they sold the "used" bass if they in fact noticed it and knew about it? I would think a boutique bass manufacturer would feel at least a little inclined to fix it at least a little bit to protect their reputation. It's a beautiful bass, make her pretty again.
